Custom Order Agreement

The foundation of every bespoke Aiyah Couture creation.

1. Overview

This Custom Order Agreement (“Agreement”) governs all custom-sized and made-on-request (bespoke) orders placed with Aiyah Couture, LLC (“Aiyah Couture,” “we,” “us,” or “our”).

By placing a custom order, the Client (“you”) agrees to the terms outlined below and acknowledges the nature of haute couture craftsmanship.

2. Nature of Couture

Aiyah Couture creations are handmade, artisanal pieces, developed through a meticulous process.

  • Each garment is individually crafted, not mass-produced.
  • Slight variations in design, embroidery, or embellishment may occur.
  • The final piece may reflect approximately 90–95% similarity to any initial concept, sketch, or reference.

These variations are an inherent part of true haute couture and are not considered defects.

3. Customization & Client Responsibility

The Client acknowledges that:

  • All measurements, preferences, and design requests provided are accurate and final.
  • Aiyah Couture is not responsible for inaccuracies in measurements submitted by the Client.
  • Perfect fit cannot always be guaranteed without physical fittings. Minor adjustments may be required after delivery.

Once the design and details are confirmed, no further modifications may be made.

4. Order Confirmation & Payment

  • A custom order is considered confirmed only after full or agreed payment is received.
  • Upon confirmation, the production process begins immediately.
  • All payments for custom and bespoke orders are final and non-refundable.

5. Production Timeline

  • Production timelines may extend up to 6 months, depending on the complexity of the design.
  • Estimated delivery timelines are provided as guidance and are not guaranteed.

Delays may occur due to:

  • Material availability
  • Craftsmanship complexity
  • Unforeseen circumstances

Clients will be informed accordingly.

6. Cancellation Policy

Due to the personalized nature of couture:

  • Custom and made-on-request orders cannot be canceled once production has begun.
  • No refunds will be issued after confirmation of the order.

7. Returns & Exchanges

  • Custom-sized and bespoke pieces are strictly non-returnable and non-exchangeable.
  • These garments are created specifically for the Client and cannot be resold.

8. Design Ownership & Intellectual Property

All designs, sketches, concepts, and final garments remain the intellectual property of Aiyah Couture.

  • Clients may not reproduce, copy, or commercially use any design.
  • Aiyah Couture reserves the right to use images and representations of the final piece for portfolio, marketing, and promotional purposes, unless otherwise agreed.

9. Quality Assurance

Each garment undergoes strict quality control before shipment.

  • Aiyah Couture ensures that all pieces meet our standards prior to delivery.
  • After delivery, Aiyah Couture is not responsible for damage caused by improper handling, wear, or alterations.

10. Shipping & Risk

  • Shipping is conducted in accordance with our Shipping Policy.
  • Risk of loss transfers to the Client once the product is handed over to the courier.

11. Limitation of Liability

To the fullest extent permitted by law, Aiyah Couture shall not be liable for:

  • Fit dissatisfaction due to incorrect measurements
  • Delays caused by external factors
  • Indirect or consequential damages

12. Agreement & Acceptance

By placing a custom or made-on-request order, the Client:

  • Confirms full understanding of the couture process
  • Accepts all terms outlined in this Agreement
  • Acknowledges that the garment is a one-of-a-kind creation

Final Note

A custom Aiyah Couture gown is not simply purchased,it is commissioned.

It is the result of time, artistry, and devotion, created exclusively for you. This Agreement ensures that both the Client and the House move forward with clarity, trust, and shared respect for the craft of couture.
