This document outlines the terms and conditions governing your use of the Aiyah Couture website and the purchase of our products and services. By accessing or using our website, you agree to be bound by these terms.

By accessing and using the Aiyah Couture website (aiyahcouture.com), you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions, our Privacy Policy, and all applicable laws and regulations. If you do not agree to these terms, please do not use our website.

• Intellectual Property Rights

All content published on the Aiyah Couture website, including but not limited to text, graphics, logos, images, video clips, digital downloads, data compilations, and software, is the exclusive property of Aiyah Couture or its content suppliers and is protected by international copyright, trademark, and other intellectual property laws. Our unique design principles and creative process are proprietary to Aiyah Couture.

You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of the service, use of the service, or access to the service or any contact on the website through which the service is provided, without express written permission by us.

• Products and Services

  • Custom Haute Couture Gowns:
    1. Our custom haute couture gowns are bespoke creations, uniquely designed and handcrafted for individual clients.

    2. The commissioning process, timeline (typically up to 6 months), and pricing are detailed during private consultations.

    3. Due to their custom nature, all custom haute couture gown commissions are final and non-refundable.

    4. Variations in fabric availability, hand-embellishment, and artistic interpretation may occur, which are inherent to bespoke creation.

  • Luxury Ready-to-Wear Collections:
    1. Our ready-to-wear pieces are crafted to order based on client measurements, with a production time of approximately 21 business days before shipment.

    2. While designed for an impeccable fit, minor alterations for regular sizes may be required at the client's expense.

    3. Product descriptions, images, and pricing are subject to change without prior notice. We make every effort to display the colors and details of our products accurately; however, we cannot guarantee that your device's display will accurately reflect the actual colors.

  • Pricing:
    1. All prices displayed on the website are in EUR unless otherwise stated.

    2. Prices for products and services are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

• Orders and Payment

  • Order Acceptance:
    Your receipt of an order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right at any time after receipt of your order to accept or decline your order for any reason.

  • Payment:
    All payments must be received in full before an order is processed or a commission begins. We accept Mastercard, Bank Transfer, Wise.

  • Billing Information:
    You agree to provide current, complete, and accurate purchase and account information for all purchases made at our website.

• Shipping & Delivery:

  • Processing & Delivery Times:
    Our estimated processing and delivery times are outlined in our dedicated Shipping & Returns Policy page. While we strive to meet these estimates, they are not guaranteed and may vary due to unforeseen circumstances or customs procedures.

  • International Shipping:
    We offer global shipping. Please note that the purchaser is responsible for any import duties, taxes, and customs fees levied by the destination country. These charges are not included in the item price or shipping cost.

  • Signature Requirement:
    For the security of your valuable order, all shipments require a signature upon delivery.

• Returns & Exchanges:

  • Our comprehensive Returns & Exchanges Policy is detailed on its dedicated page. By placing an order, you agree to the terms outlined therein.

  • Please note that custom haute couture gowns are final sale and non-returnable due to their bespoke nature.

  • For Luxury Ready-to-Wear, specific conditions apply for returns or exchanges, typically within seven (7) calendar days of delivery, for products that meet strict return criteria (e.g., product defect, lost shipment, wrong product).

• User Conduct and Prohibited Uses

  • You agree not to use the website or its content for any unlawful purpose, to solicit others to perform or participate in any unlawful acts, to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances, or to infringe upon or violate our intellectual property rights or the intellectual property rights of others.

• Disclaimer of Warranties; Limitation of Liability

  • We do not guarantee, represent, or warrant that your use of our service will be uninterrupted, timely, secure, or error-free. We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.

    In no case shall Aiyah Couture, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product.

• Indemnification

  • You agree to indemnify, defend and hold harmless Aiyah Couture and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

• Governing Law

  • These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Kosovo, without regard to its conflict of law provisions.

• Changes to Terms & Conditions

  • We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms & Conditions by posting updates and changes to our website. Where we have your email address, we will endeavor to notify you of significant changes to these Terms & Conditions at least two (2) months prior to their effective date. It remains your responsibility to check our website periodically for changes. Your continued use of or access to our website following the posting of any changes to these Terms & Conditions constitutes acceptance of those changes.
